This website is owned and operated by Elements Inc.  We are committed to protecting the privacy of our visitors while they interact with the content, products and services on this site (the “Site”).  This Privacy Policy applies to the Site only. It does not apply to other websites to which we link.  Because we gather certain types of information about our users, we want you to understand what information we collect about you, how we collect it, how that information is used, and how you can control our disclosure of it. You agree that your use of the Site signifies your assent to this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Site.

Information Collected

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

 

How We Use Your Personal Information

patagoniaelements.ca uses your order information to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Sharing Your Personal Information

patagoniaelements.ca shares your Personal Information with third parties to help us use your Personal Information, as described above. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Please note that personally identifiable information is used only to provide you with a more enjoyable, convenient online experience and to help us identify and/or provide information, products or services that may be of interest to you. We use your personally identifiable information to support and enhance your use of the Site and its features, including without limitation: fulfilling your order; providing customer service; tracking email invitations you send; and otherwise supporting your use of the Site.

How We Protect Your Information

We are committed to protecting the information we receive from you. We take appropriate security measures to protect your information against unauthorised access to or unauthorised alteration, disclosure or destruction of data. To prevent unauthorised access, maintain data accuracy, and ensure the correct use of information, we maintain appropriate physical, electronic, and managerial procedures to safeguard and secure the information and data stored on our system. While no computer system is completely secure, we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved.

Email Choice/Opt-out

If any user who receives an email from the Site and would prefer not to receive such communications in the future, [he or she] can do so by following the instructions in the emails. 

Children's Privacy and Parental Controls

We do not solicit any personal information from children. If you are not 18 or older, you are not authorised to use the Site. Parents should be aware that there are parental control tools available online that can be used to prevent children from submitting information online without parental permission or from accessing material that is harmful to minors.

Disclaimer to Security

By consenting to the Terms and Conditions of the Site and hence the Privacy Policy, you consent that no data transmission over the Internet is completely secure. We cannot guarantee or warrant the security of any information you provide to us and you transmit such information to us at your own risk.

Notification of Changes

patagoniaelements.ca reserves the right to change this Privacy Policy from time to time at its sole discretion. If at some point in the future, there is a change to our Privacy Policy, unless we obtain your express consent, such change will only apply to information collected after the revised Privacy Policy took effect. Your continued use of the Site indicates your assent to the Privacy Policy as posted.

Elements Outfitters Policy on Patagonia Product; Bulk Orders, End Use and Reselling

This policy outlines Patagonia Elements and Elements Outfitters position on the sale of Patagonia product in the grey market and sets procedures and controls designed to identify and avoid sales to purchasers buying product in bulk and/or accumulating product over time to sell in the grey market. This policy applies to all Elements Outfitters Patagonia customers…

Our Storefronts are for engagement, customer service and the end user. We condone gift giving and sharing the Stoke associated with our brands, however merchandise in our storefronts and on our e-commerce site is for the end use customer. We do not sell our merchandise to a third party for resale, or process group sales or bulk orders in our storefronts. Group order inquiries are welcome, however may be limited by the amount of product available beyond our retail
storefronts… Organizations interested in bulk purchases should direct their inquiry to

  • All Patagonia product purchased from Patagonia Elements or Elements Outfitters retail stores and website must be purchased by the end user of said product or as a personal gift.
  • The sale of Patagonia product to a customer that is not the end user of the product or giving the product as a personal gift is prohibited.
  • While there is not a limit to the amount of Patagonia product a customer can buy for their own personal use, unusually large purchases and consistent buying patterns that indicate the customer is not buying for themselves or as a personal gift will be scrutinized by Elements Leadership.
  • Patagonia Elements and Elements Outfitters reserves the right to discontinue doing business with customers that exhibit buying patterns deemed inconsistent with end user consumption.
  • All Patagonia product purchased as part of a group order (educational institution, nonprofit or business to business partner) must be reviewed by Elements HQ and approved before the order is fulfilled.
  • Customer service including returns, exchanges and refunds for group orders will be processed through grouporders@elementsinc.ca (not in Elements Storefronts)
